Original Position Pilot Program User Agreement

Effective September, 2025

This Agreement outlines the policies, expectations, and disclaimers associated with participating in the Original Position Pilot Program (“Pilot Program”) operated by Original Position (“OP”). By enrolling in the Pilot Program, you agree to be bound by this Agreement.

OP may update this Agreement from time to time. Updates will be posted at www.original-position.org/pilot-user-agreement. Continued participation in the Pilot Program after an update constitutes acceptance of the revised terms.

About Original Position

Original Position is a nonprofit public charity incorporated in Wyoming and recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code (EIN: 99-4320772). Our mission is to help individuals align their money with their values and to increase charitable giving in ways that support both personal fulfillment and collective flourishing.

Participation in the Pilot Program

The Pilot Program is designed to test and improve OP’s approach to financial clarity, values-based decision making, and charitable giving. Participation may include completing exercises, attending workshops, engaging with digital tools, and providing feedback.

Participation is voluntary. You may withdraw from the Pilot Program at any time by notifying OP at info@original-position.org.

Donor-Advised Fund Option

As part of the Pilot Program, members may be invited to open an account with the Original Position Donor-Advised Fund (“OPDAF”). Use of OPDAF is entirely optional and requires acceptance of the separate OPDAF Member Agreement available at https://www.original-position.org/DAF/member-agreement.

Nothing in this Pilot Program Agreement alters or replaces the terms of the OPDAF Member Agreement. If you do not open a Fund, the OPDAF provisions do not apply to you.

No Legal, Tax, or Investment Advice

The Pilot Program is intended for educational and informational purposes only. OP and its representatives are not providing financial, investment, tax, or legal advice. You are encouraged to consult with qualified professionals regarding your personal circumstances before making financial or charitable decisions.

Privacy and Data Use

OP collects and processes information you provide through the Pilot Program to deliver services, improve our tools, and conduct research on giving behavior. OP will not sell your personal information. Data may be aggregated and anonymized for research and reporting purposes. Any data used to improve OP’s digital tools, including training of AI models, will first be anonymized and aggregated so that it cannot be traced back to you. Fees

There is no required fee to participate in the Pilot Program. OP may invite voluntary contributions to support its work. Any future fee structure will be clearly communicated before implementation.

Termination

You may withdraw from the Pilot Program at any time. OP reserves the right to suspend or terminate your participation if you violate this Agreement or engage in conduct that is unlawful, disruptive, or harmful to OP or other participants.

Limitation of Liability

To the fullest extent permitted by law, OP shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in the Pilot Program.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming.
